Hi guys, hoping you can help me.

Recently I saw a graphics card on Overclockers.co.uk at a good price, bundled with a copy of ‘Hitman Contracts’ and CS:CZ. I went along and bought the card.

When the card arrived, all worked well but CS:CZ was missing from the package. I’ve been in contact with their support and they refuse point blank to do anything about the missing copy of CS:CZ.

Can someone please tell me where I stand and so what I can do?

Thanks.

Not sure what you can do about that err go to your local citizens advice? And they will tell yo what to do and what you can do.

You had a contract with them for you to pay an agreed sum of money and for them to provide what was advertised. Did you pay by Credit Card? If so then you can take this up with the card issuer as well and they may put pressure on them to sort things for you.

Importantly, do you have a copy of the webpage in your cache or does the page still advertise CS:CZ? You may have trouble proving it if the page isn't available as evidence.

I'm sure other more knowledgeable people will add more info or correct any innacuracies in my post :)

HTH?

Problem is proving it wasn't in the box when you got it :S

BB: No I paid by debt card.
No I don't have the page in cache and they have since changed the page.

But! At first they claimed that they no longer did the deal, and later changed their argument to that they never did the deal in the first place and that it was a typo. Isn’t that shooting themselves in the foot a tad?

Bob: They know and have agreed that they did not send me a copy and clearly they don't want to!  :(

Sadly you're probably stuffed  :(

They are legally bound to supply you with the goods you agreed with them i.e. the card and two games. So they're in breach of the contract and you could sue them in a small claims court. Sadly as has been mentioned you've a snowballs chance in hell of winning as you have no proof they offered CS:CZ as part of the deal.

Whatever's gone wrong it's not my fault.

But they admitted it!

First they said they were no longer doing this deal

Then they claimed it was a typo (Text and image?!)

...And they are still selling some card with the bundle

You need to find out exactly why they won't honour the agreement. Get the name of the prson you are speaking to and ask them to explain exactly what their position is. If the offer is still on their web site ask them why you have been told you can't take that offer.

You should have been sent an order confirmation (by e-mail) which would show exactly what you purchased. Without that you're unlikely to get the probelm sorted.

If you did get it then you have a better chance of getting the extra game.

Basically if you can prove the deal was for a card and two games then you're OK, and if you can't then you're stuffed. Sadly what they may or may not have said to you or admitted over the phone isn't going to be any use. You'll need hard evidence like e-mail order confirmations or something that came in the box with the goods.

Had trouble with OC a few years ago over a duff memory, they charged me for testing it(£10) even though it was faulty(they even sent e-mail saying so). Then they sent the same module back as replacement(I marked inside heatsink ;) ).I went straight to tradeing standards and the problem was sorted in 4 days. :) If you cant be bothered with the chew,pm me with your addy and I will send you a copy for free.My supplier actually sends me graphics cards complete with cz   ) ,but alot of customers dont want it so I have a few laid about.

Overclockers.co.uk are good on price but awful on service. Overclock.co.uk on the other hand are great on both, not that it helps you here Frenzy.

If you can produce the product on a web page if it is still for sale and send the link to your local Trading standards department (or screenshot or cached version with date info), stating you did not receive the goods as described, under trading standards law you are entitled to a full refund or the goods you ordered (I used to work for Trading Standards).

Worth a go, but hardly worth getting blacklisted by them for since they are more beneficial to you than you are to them (it seems).  :(
Cheers, Bert
