My point still stands. It would depend on the circumstances. A sober man doing it would get a smack in the face. A paralytically drunk person who had no idea what they were ****ing on would not. Likewise if it was a four year old child run away from it's parents for a few moment I'd have a hard time hating them for defacing a grave. it depends on the circumstances. In this case we're talking about the bloke 'did not know' that he was ****ing on a war memorial because 'he was very very drunk'. That makes his crime completely different from someone sober who did it because the sober man would know exactly what he was doing. I can see the very clear distinction between the two, as did the courts.

and well, he didn't do it on purpose, so yes that really does count!

I think it sucks he got 250 hours of community service just for that! There are genuine bad/evil persons our there that get way less then they deserve, just because they granted them temporary insanity and give them hardly any punishment, or because cops or people of law make stupid mistakes! :ranting2:

Even if he knew what he was ****ing on that's not the point I was making.

If he knows what he's doing and he peed on a playground would he have ended up in court or with that sentence. That's understandable, different things have different punishments.

If he'd have peed on the same memorial and was caught by the police and it didn't get picked up by the papers then what are the odds he's have even been charged with anything. It's dangerously close to letting the papers decide who is guilty if you don't send people to court without an article being written about it.

What he did was wrong, he deserves the sentence he got. There are probably thousands of people each year doing equivalent crimes and not being punished. You either punish them all or none of them. Don't let the papers choose.

Seeing they give them community service any way it would be very easy to fix the problems. Go out at a weekend with a camcorder. Film people being drunk and disorderly and doing these sorts of things. Then give them X hours community service. Which would be used cleaning up the town centre.

With less people messing the place up (because they get caught...it's a deterrent) and more people cleaning it I imagine that very quickly it would be a lot nicer to be in towns even on a friday night. They have the powers to do it now, but it would get them negative press when it's first introduced with all the stories like:

 "John was enjoying 12 pints with his mates like he does every weekend when he was caught throwing up into a gutter. The police over reacted and gave him community service. This means his benefits have been place under review. Without that money he'll struggle to feed his 7 children with 5 different mothers."
